END-USER LICENSE AGREEMENT

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS

This End-User License Agreement for KR Services Off-The-Charts

("SOFTWARE PRODUCT") is a legal agreement between you

(either an individual or an entity) and KR Services Team ("AUTHOR").

You agree that your use of the SOFTWARE PRODUCT acknowledges that you have read

this license, understand it, and agree to be bound by its terms and conditions.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT,

DO NOT INSTALL AND/OR USE THIS SOFTWARE.

1. LICENSE GRANT

The SOFTWARE PRODUCT is licensed, not sold, to you by AUTHOR for use only

under the terms of this License, and AUTHOR reserves any rights not

expressly granted to you.

1.1 LICENSE TYPES

AUTHOR provides the following types of licenses - EVALUATION LICENSE(TRIAL MODE),

SINGLE USER PERMANENT LICENSE, MULTI-KEY COMPUTER PERMANENT LICENSE.

The licenses differ in the product features' availability. The Feature Comparison

is available on the KR Services web site http://www.KR-Services.com

Before purchasing a license, you have to install the trial version of the

SOFTWARE PRODUCT and verify that the SOFTWARE PRODUCT is working correctly and

as expected on your computer.

With any the Off-The-Charts PERMANENT licenses, you are granted a one-year

maintenance period of technical support and SOFTWARE PRODUCT updates from the date

of purchase. Upon expiration, you need to purchase any SOFTWARE PRODUCT updates,

otherwise you may stay with your current version of the SOFTWARE PRODUCT.

1.2 EVALUATION LICENSE ENTITLEMENT

The EVALUATION LICENSE ENTITLEMENT only applies when you obtain a copy of the

SOFTWARE PRODUCT for the first time. You may use the Evaluation (Trial)

Version of the SOFTWARE PRODUCT for a pre-determined evaluation period, preset

for that current version by the AUTHOR. After the evaluation period, the SOFTWARE

PRODUCT is designed to disconcontinue functionality until license key is obtained

from AUTHOR.Data sets created with the SOFTWARE PRODUCT under EVALUATION LICENSE

CANNOT be used for commercial purpose, can not be saved via program features,

is not entitled to any technical support, and contain the references "TRIAL

VERSION and SHEET ERRORS!".

1.3 SINGLE USER PERMANENT LICENSE ENTITLEMENT

The SINGLE USER PERMANENT LICENSE ENTITLEMENT only applies after you have purchased

the SINGLE USER LICENSE from AUTHOR.

AUTHOR grants to you a personal, non-transferable and non-exclusive right to use

the copy of the SOFTWARE PRODUCT provided with this License.

The SINGLE USER LICENSE authorizes you to use one copy of the version of this

SOFTWARE PRODUCT on a single computer you have provided the specific I'D' number

for, prior to delivery of said keys.

Data sets created with the SOFTWARE PRODUCT under SINGLE USER LICENSE can be saved

via program features, and

used for commercial purpose and contain the references to the purchaser.

The maintenance period for SINGLE USER license is limited for one year from the

date of purchase.

The SINGLE USER license is not qualified for maintenance renewal.

1.4 MULTI-KEY COMPUTER PERMANENT LICENSE ENTITLEMENT

The MULTI-KEY COMPUTER PERMANENT LICENSE ENTITLEMENT only applies after you have

purchased the MULTI-KEY LICENSE from AUTHOR.

AUTHOR grants to you a personal, non-transferable and non-exclusive right to use

one version copy of the SOFTWARE PRODUCT with this License on multiple computers.

The Off-The-Charts PERMANENT LICENSE authorizes you to use one specific version

copy of the SOFTWARE PRODUCT on computerS you have provided the specific

I'D' numbers for, prior to delivery of said keys.

The maintenance period for Off-The-Charts PERMANENT license is limited for

one year from the date of purchase.

Data sets created with the SOFTWARE PRODUCT under Off-The-Charts PERMANENT LICENSE

can be saved via program features and can be used for commercial purpose

and contain the references to purchaser and

SOFTWARE PRODUCT.

2. ORDERING

3. NO REFUND

No refund is given at any time, unless authorized by the AUTHOR under unexpected

circumstances. The AUTHOR reserves the right to provide refunds, or make any

commercially reasonable efforts to solve any issues at his discretion.

Please contact the AUTHOR to see if you qualify for a refund.

4. DISCLAIMER OF WARRANTY AND LIABILITY

THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS. AUTHOR DISCLAIMS ALL WARRANTIES

RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT

LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR

PURPOSE. NEITHER AUTHOR NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION,

PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT,

CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE

SUCH SOFTWARE, EVEN IF AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH

DAMAGES OR CLAIMS. THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE

QUALITY AND PERFORMANCE OF THE SOFTWARE. AUTHOR MAKES NO CLAIM NOR STATEMENT OF

ANY ASSOCIATION WITH, NOR ANY TYPE OF APPROVAL FROM, THE AIRCONDITIONING CONTRACTORS

OF AMERICA (ACCA), WITH REGARDS TO THIS PRODUCT.

5. EXCEPTIONS

No exceptions to any portion of this license agreement will be allowed without

the express written permission of AUTHOR.

KR Services - Off-the-Charts will not share ANY client or trial-client information woth ANY other party or person, except by legal order of a court of law. We will send update notices to our clients (blind copy email), but will never use this priveledge to advertise new product. If "Tech Support Remote Control" is requied to resolve installation or technical issues, ANY information witnessed on the client's computer during a desktop-sharing session is strictly confidential to KR Services, and only for the purpose of assisting hte client's needs.
